April 19, 2013 – A response to FHPORT’s April 5, 2013 newsletter

In response to FHPORT’s April 5, 2013 newsletter, we offer the following FACTS.

Did You Know that the Master Declaration of Fairfield Harbour states every person acquiring property in Fairfield Harbour becomes a member of the POA, and, as a POA member, has a contractual obligation to pay the annual dues on that property to remain a POA member in good standing?

Did You Know that only POA members in good standing can vote on community matters?

Did You Know that to anticipate and plan for non-payment by 7% of POA members (about 200 properties) our dues must be increased by $50 per member? Our current $659 bill would be closer to $609 if everyone fulfilled his/her contractual obligation.

Did You Know that our DOR’s state that after 30 days, unpaid dues “shall become a lien” and “may be foreclosed at any time.” CAS makes three attempts to encourage payment before transferring the account to a collection agent. If even this action fails, the POA-BOD has no choice but to file a lien. It does have discretion regarding foreclosures and can weigh individual circumstances.

Did You Know that according to records filed with our North Carolina Secretary of State, Treasure Cove POA filed articles of incorporation in 1972? And, in 1979, the TC-POA voted to simply change its name to the Fairfield Harbour Property Owners Association?

Did You Know the 2013 POA Final Budget Expense Overview shows 8% of our FH-POA budget, or $146,000, is budgeted for legal fees? That’s more than $50 of each member’s annual dues.   Is FHPORT actually suggesting we’d support even more litigation?

Did You Know that hurricane (Irene) cleanup is a power granted in our Association Bylaws? (Please see Article V, J2(b).

These are FACTS, not fiction.

Are FHPORT and others relying on your reluctance to investigate? Have they actually proven anything?

Who are we? We meet our community responsibilities. We honor the contracts we sign and we recognize our rights and our obligations as Association members and citizens of a single, united Fairfield Harbour. We believe in facts; we leave fiction to the storytellers.

We do ask that you question, investigate, and determine for yourselves what is FACT, and what isn’t.
