March 14, 2014 – The long day in court is behind us, but our community’s future remains to be decided.

For three long years, a pall has hung over our community. Those of us who never doubted the honesty and sincerity of our elected Directors watched in dismay while false charges were leveled and lives disrupted.

With Judge Nobles’ recent ruling in the Summary Judgment, their nightmare and ours has ended at last.

On March 14, the so-called “Conspiracy Lawsuit” in which Neal Gumpel, Pete Drez and others brought charges against the Fairfield Harbour Property Owners Association, and its Directors, individually as well as officially was dismissed. The suit alleged that Directors Bob Dumon, Joan Taylor, Paul Hill, Chris Skrotsky, Brian Giersch, Wayne Strausbaugh, Larry Knapp, BOD treasurer Bob Ostar and then Property Manager Revonda Stewart wrongfully participated in malicious prosecution, abuse of process, negligent hiring/retention/supervision, and civil conspiracy. Judge Nobles granted the motion of Summary Judgment filed by the POA and deemed that the case did not merit trial.

Judge Nobles further ruled out any punitive judgment against the plaintiffs by stating that each side must bear its own costs of the proceedings.

It’s over! Spring will come, at last, and we in Fairfield Harbour can finally turn our full attention to the many positives of life in our community.
